A conveyancing  issue concerning property in Boyatt Wood, Eastleigh:

Boyatt Wood is an area developed in the 1970s and 1980s broadly bounded by the M3 on the west, the Eastleigh-Romsey railway line on the South  and the local authority estate off Twyford Road on the east.

The land was owned by the Chamberlayne family who sold it off for development to various builders.   When they sold the land they imposed restrictive covenants which can still affect building work and the use of land and buildings.   The most significant of these are:

  • A restriction on any building work  without consent.

  • No external aerials or satellite dishes unless Chamberlayne Estates are satisfied that without them reception would not be satisfactory

  • Garages are only to be used for the garaging of private motor vehicles (and not converted into  habitable rooms).

IT IS IMPORTANT THAT YOU UNDERSTAND THIS HAS NOTHING TO DO WITH PLANNING AND BUILDING REGULATIONS.   Even if you have these consents, or they were not needed, the covenants still apply and when selling, if there are any extensions aerials etc., your buyer's solicitors are likely to want to see consents under the covenants for them.

In some cases consent is also needed for the same works from the builder that originally built the property.
